Terms and conditions of sale and use

1. Purpose

These terms and conditions (the "Terms") govern access to and use of the MullTrade service, available at mulltrade.fr (the "Publisher"), by any user who creates an account (the "Client"). Creating an account or purchasing a license implies full acceptance of these Terms, as well as of the risk warning and the privacy policy.

2. Description of the service

MullTrade is a software tool for the automatic copying of signals: it connects the Telegram account and the trading account (MetaTrader 4, MetaTrader 5 or TradeLocker) specified by the Client, and automatically reproduces on that account the messages it interprets as trading orders coming from the Telegram group/channel freely chosen by the Client.

MullTrade does not select, recommend, verify or endorse any signal, channel or trader. The choice of the signal source to follow rests exclusively with the Client. MullTrade provides neither investment advice, nor portfolio management, nor financial analysis services: it is a technical automation tool, not a financial intermediary.

The service is offered in two plans. The Standard plan relies on a rule-based analysis of common message formats (entry, stop loss, take-profit, French and English). The AI plan entrusts the reading of the trader's messages to an artificial intelligence model, intended for less regular formats. In both cases, a message that the service cannot interpret with certainty does not give rise to any order.

The Standard plan can follow up to 5 Telegram groups or channels. The AI plan follows 1; the "5 channels" option, billed per month of license, raises this number to 5. When the AI plan is renewed without this option, only the first channel chosen remains followed.

Fixed residential IP option. As an option, the Client can have their bot connect to their broker and to Telegram from a fixed residential IP address, supplied by a third-party provider, in the country of their choice, instead of MullTrade's servers. The address is assigned automatically after payment and kept for the entire paid duration of the option; until it is assigned, the bot does not start. At the end of the paid duration, if the option is not renewed, the bot connects again from MullTrade's servers. The option in no way changes the rules of the Client's broker or funding company (prop firm), which the Client is responsible for complying with.

3. Account creation and access to the service

Access to the service requires creating an account (email + password), confirming the email address, two-factor authentication by a code sent by email, and then purchasing a license. The Client's trading and Telegram credentials are only requested after the purchase of a license, and are stored encrypted.

The Client guarantees that they are the sole holder of, or duly authorized to use, the trading and Telegram accounts they connect to the service. The Client is solely responsible for the confidentiality of their MullTrade login credentials.

4. Prices and payment

The prices in force are displayed on the home page, in euros. The Client chooses a plan (Standard or AI) and an access duration (1, 6 or 12 months, the longer durations benefiting from a reduced price), paid in a single payment, as well as, if they wish, the options (fixed residential IP; 5 channels for the AI plan), billed per month of license. Payment is made by bank card, Apple Pay or Google Pay via the third-party provider Stripe, or in cryptocurrencies (BTC, ETH, SOL, USDT, USDC) via the third-party provider NOWPayments. The license is activated automatically as soon as payment is confirmed, for the chosen duration; a license purchased for an existing bot extends its expiry date. On expiry, access is not renewed automatically: the Client must make a new payment from their account if they wish to continue; MullTrade never charges automatically.

A 3-day free trial of the Standard plan is offered once per person (once per email address, Telegram account and trading account), without any payment method. At its end, the service is suspended if no license is purchased. The trial is not available for the AI plan or for accounts created through a referral link. Referral: when a referred user's first payment is confirmed, one additional month of access is added to the referrer's license (once per referred user).

Refunds owed to the Client (withdrawal, residential IP not assigned, error attributable to MullTrade) are made within 14 days, using the same payment method as the one used for the purchase, unless the Client expressly agrees to another method. A cryptocurrency payment is refunded at its equivalent value in euros (the price being set in euros), in the same cryptocurrency or by bank transfer, at the Client's choice. If the residential IP cannot be assigned within 7 days of payment, the part of the price corresponding to the option is refunded.

5. Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, a Client who is a consumer has 14 days from the conclusion of the contract (confirmation of payment) to withdraw, without having to give any reason or pay any penalty.

By ticking the box provided at the time of purchase, the Client expressly requests that the service begin before the end of this period. If they then withdraw, they remain liable, in accordance with article L221-25 of the French Consumer Code, for an amount proportional to the service provided until the withdrawal was communicated; the rest of the price is refunded. A renewal license whose period has not yet started is refunded in full.

To withdraw, the Client uses the "Withdraw from the contract here" button displayed in their client area (License tab) during this period, or sends an unambiguous statement to [email protected], for example using the model below. An acknowledgement of receipt is sent to them by email. Withdrawal ends the license concerned: the bot is stopped or, for a renewal, returns to its previous expiry date. The free trial, which involves no payment, is not concerned.

Model withdrawal form — To MullTrade, [email protected]: "I hereby give notice that I withdraw from my contract for the provision of the following service: MullTrade license ordered on [date], account email address [email], name [name]. Date: [date]."

6. Duration and termination

The license is concluded for the chosen duration and ends on expiry, without automatic renewal. The Client may stop using the service at any time. MullTrade may suspend or terminate a Client's access in the event of a serious breach of these Terms, fraudulent use, or behavior endangering the security or stability of the service, after informing the Client where the situation allows.

7. Client's obligations

The Client undertakes to:

• provide accurate trading and Telegram credentials which they are legitimately entitled to use;
• comply with the conditions of their broker, their funding company (prop firm) and Telegram, in particular regarding access by a third-party service to their account, automated trading and signal copying;
• assess for themselves the risks of the channel/trader they choose to follow and choose settings (position size, limits) suited to their capital;
• reasonably monitor their trading account and balance;
• not use the service for illegal or fraudulent purposes.

8. Liability

MullTrade is a technical execution tool. The Client remains the sole decision-maker for their trading choices, the channel they follow and their bot's settings. MullTrade uses reasonable means to ensure that the service operates in accordance with its description (obligation of means): in particular, a message that the service does not understand with certainty does not give rise to any order.

MullTrade can only be held liable in the event of a proven breach of its obligations, for the direct damage resulting from it. MullTrade is not liable for:

• the content, quality or results of the signals published by the channel chosen by the Client, nor for losses resulting from the faithful execution of these signals and of the Client's settings;
• the decisions, actions or failures of the Client's broker, funding company, Telegram, the residential IP provider or any other third-party service, nor their interruptions or latency;
• force majeure.

For a professional Client, and except in the case of gross negligence or wilful misconduct, MullTrade's liability is limited to the amount paid for the current license. See also the risk warning, which forms an integral part of these Terms.

9. Intellectual property

The code, the signal analyzers and the infrastructure of the service remain the property of MullTrade. Purchasing a license grants a right to use the service, not a transfer of intellectual property.

11. Complaints and mediation

Any complaint should be sent to [email protected]; MullTrade replies within 15 days. Failing an amicable solution, a Client who is a consumer may refer the matter, free of charge, to the consumer mediator to which MullTrade belongs: contact details provided on request at [email protected].

12. Governing law

These Terms are governed by French law. Failing an amicable resolution, any dispute falls within the jurisdiction of the competent courts; a Client who is a consumer may bring proceedings before the court of their place of residence.

These Terms are written in French. The translations offered on the site (English, German, Spanish, Italian, Turkish) are provided for information; in case of discrepancy, the French version prevails, without prejudice to mandatory provisions more favorable to the consumer.
